DMCA Policy

1. Introduction and Safe Harbor

GreekNerds respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, GreekNerds has designated an agent to receive notifications of claimed copyright infringement. By complying with the DMCA’s notice-and-takedown provisions, GreekNerds qualifies for the safe harbor protections set forth in 17 U.S.C. § 512(c), which limits the liability of online service providers for copyright infringement by their users.

If you believe that content posted on GreekNerds infringes your copyright, please follow the procedure described below to submit a valid DMCA takedown notice.

2. How to Submit a DMCA Takedown Notice

To be valid and actionable, your DMCA takedown notice must be in writing (electronic or paper) and must include all of the following elements:

1. Identification of the copyrighted work. Describe the copyrighted work or works that you claim have been infringed. If you are asserting infringement of multiple copyrighted works at a single online site, you may provide a representative list.
2. Identification of the infringing material. Identify the material on the GreekNerds Site that you claim is infringing, with sufficient specificity to allow GreekNerds to locate it. Please include the full URL(s) of the specific page(s) containing the allegedly infringing material.
3. Your contact information. Provide your full legal name, mailing address, telephone number, and email address so that GreekNerds and, if necessary, the user who posted the material, can contact you.
4. Good faith statement.Include the following statement: “I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
5. Accuracy statement under penalty of perjury.Include the following statement: “I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the copyright owner of an exclusive right that is allegedly infringed.”
6. Physical or electronic signature. A physical signature or a valid electronic signature of the copyright owner or a person authorized to act on their behalf. Typing your full name at the end of an email or electronic submission constitutes a valid electronic signature.

Incomplete notices may not receive a response. GreekNerds reserves the right to request additional information to process your notice.

3. Designated DMCA Agent

4. What Happens After We Receive Your Notice

Upon receipt of a valid and complete DMCA takedown notice, GreekNerds will:

1. Promptly remove or disable access to the allegedly infringing content.
2. Take reasonable steps to notify the user who posted the content that it has been removed in response to a DMCA notice.
3. Provide the user with a copy of the takedown notice (with your personal contact information redacted where reasonable and legally permissible).

GreekNerds will document the notice for compliance purposes but does not make legal determinations about whether content is actually infringing.

5. Counter-Notification Procedure

If you believe that content you posted was removed as a result of a mistake or misidentification — for example, because your use was authorized by the copyright owner, the material was not protected by copyright, or your use constitutes fair use — you may submit a counter-notification.

A valid counter-notification must be in writing and include all of the following:

1. Your contact information. Your full legal name, mailing address, telephone number, and email address.
2. Identification of removed material. A description of the material that was removed and the URL at which it appeared before it was removed.
3. Consent to jurisdiction.The following statement: “I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or, if my address is outside of the United States, the judicial district in which GreekNerds is located, and I will accept service of process from the person who provided the original DMCA notification.”
4. Good faith statement under penalty of perjury.The following statement: “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”
5. Physical or electronic signature. Your physical or valid electronic signature.

Send counter-notifications to our Designated Agent at dmca@greeknerds.comwith the subject line “DMCA Counter-Notification.”

Upon receipt of a valid counter-notification, GreekNerds will forward it to the original complainant and, unless the complainant notifies us that they have filed a court action seeking an injunction against the infringing activity, we will restore the removed content within 10 to 14 business days in accordance with 17 U.S.C. § 512(g).

6. Repeat Infringer Policy

In appropriate circumstances, GreekNerds will terminate the accounts of users who are determined to be repeat infringers of copyright. A “repeat infringer” is a user against whom GreekNerds has received multiple valid DMCA takedown notices that resulted in content removal, or a user who has otherwise demonstrated a pattern of copyright infringement. GreekNerds retains sole discretion to determine whether a user qualifies as a repeat infringer and to take appropriate action, up to and including permanent account termination.
